These Terms of Service ("Terms") govern your access to and use of bestdamnresume.com (the "Site") and all related services, features, and content offered by Best Damn Resume ("we," "us," or "our"). By accessing or using the Site, you agree to be bound by these Terms. If you do not agree, do not use the Site.

1. Eligibility

You must be at least 16 years old to use our services. By creating an account or using the Site, you represent and warrant that you meet this age requirement and have the legal capacity to enter into these Terms.

2. Account Registration

Certain features require you to create an account. When you register, you agree to:

Best Damn Resume provides AI-powered tools for career development, including but not limited to:

• Resume building and formatting
• AI-powered resume enhancement and tailoring
• ATS (Applicant Tracking System) compatibility checking
• Cover letter generation
• Interview preparation
• Job search and matching
• Job application tracking

We reserve the right to modify, suspend, or discontinue any part of our services at any time, with or without notice. We will make reasonable efforts to notify active subscribers of material changes.

4. Free and Paid Plans

Free Tier

Free accounts have limited access to features, including caps on AI-powered operations, resume versions, and templates. We may adjust free tier limits at any time.

Pro Subscription

Paid subscriptions unlock additional features and higher usage limits as described on our pricing page. Subscription details, including pricing and billing frequency, are presented at the time of purchase.

Rate Limits

All users are subject to rate limits on AI-powered features to ensure fair use and service quality. Anonymous visitors (not logged in) have lower limits. Exceeding rate limits may temporarily restrict access to certain features.

5. Payments and Billing

• All payments are processed securely through Stripe. We do not store your credit card information.
• Subscriptions automatically renew at the end of each billing period unless canceled before the renewal date.
• Prices are listed in USD and are subject to change. We will notify existing subscribers before any price increase takes effect on their account.
• You are responsible for any applicable taxes.

6. Cancellation and Refunds

• You may cancel your subscription at any time through your account settings or by contacting us.
• Upon cancellation, you retain access to paid features until the end of your current billing period.
• We do not provide prorated refunds for partial billing periods.
• If you believe you were charged in error, contact us within 30 days of the charge for review.

7. Your Content

You retain ownership of all content you upload or create on the Site, including resumes, cover letters, and personal information ("Your Content").

By using our services, you grant us a limited, non-exclusive license to process Your Content solely for the purpose of providing and improving our services. This includes sending Your Content to third-party AI providers for processing as described in our Privacy Policy.

We do not claim ownership of Your Content, and we do not use it to train AI models.

8. AI-Generated Content

Our services use artificial intelligence to generate, enhance, and tailor content. You acknowledge that:

• AI-generated content is provided as a starting point and should be reviewed by you before use
• We do not guarantee the accuracy, completeness, or suitability of AI-generated content
• You are solely responsible for reviewing, editing, and verifying all content before submitting it to employers or other parties
• AI outputs may occasionally contain errors, inaccuracies, or content that does not accurately reflect your experience
• Similar inputs may produce similar outputs for different users — AI-generated content is not guaranteed to be unique

9. Acceptable Use

You agree not to:

• Use the Site for any unlawful purpose or in violation of any applicable laws
• Upload false, misleading, or fraudulent information in resumes or other content
• Attempt to circumvent rate limits, access controls, or security measures
• Use automated scripts, bots, or scrapers to access the Site or its services without permission
• Interfere with or disrupt the Site, servers, or networks connected to the Site
• Reverse engineer, decompile, or attempt to extract the source code of any part of the Site
• Resell, redistribute, or commercially exploit our services without written permission
• Impersonate another person or entity

10. Intellectual Property

The Site, including its design, code, features, logos, and branding, is owned by Best Damn Resume and protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works based on our intellectual property without prior written consent. Resume templates provided through the service are licensed for your personal use only.

11. Disclaimer of Warranties

THE SITE AND SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that: (a) the Site will be uninterrupted, secure, or error-free; (b) AI-generated content will be accurate, complete, or suitable for any particular purpose; (c) use of our services will result in job interviews, offers, or employment; or (d) ATS compatibility scores guarantee passage through any specific applicant tracking system.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BEST DAMN RESUME AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE OR SERVICES, WHETHER BASED ON WARRANTY, CONTRACT, TORT, OR ANY OTHER LEGAL THEORY. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

13. Indemnification

We may suspend or terminate your account and access to the Site at any time, with or without cause, and with or without notice. Reasons for termination may include, but are not limited to, violation of these Terms, abusive behavior, or fraudulent activity.

Upon termination, your right to use the Site ceases immediately. Sections of these Terms that by their nature should survive termination (including ownership, warranty disclaimers, indemnification, and limitations of liability) will survive.

15. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Ohio, United States, without regard to its conflict of law principles. Any disputes arising from these Terms or your use of the Site shall be resolved in the state or federal courts located in Hamilton County, Ohio.

16. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on this page and updating the "Last updated" date. Your continued use of the Site after changes are posted constitutes your acceptance of the revised Terms.
